Sarasota, FL – Here are 6 “short sale secrets” I have learned over the years as a Sarasota Short Sale Agent with Keller Williams Realty. If you are hired to help a Florida homeowner with a short sale, these tips are for you.

  1. Listen carefully to your seller and their concerns, and stay connected to them throughout the short sale process.  Good communication is paramount.
  2. Before you meet the seller, check county records to ensure that it isn’t too late to short sale their property. You don’t want to waste their time.
  3. Be prepared to provide excellent resources and contacts (attorneys, CPAs, etc.) for your sellers.
  4. Perform the Title Search early on your seller’s property  and start negotiating as soon as possible with 3rd party lien holders to ensure everything happens in a timely manner.
  5. Do not take the property off the market without a significant deposit from a buyer.
  6. Do your homework on the buyer before an agreement is reached.  Buyers need to be pre-qualified and need to schedule inspections without delay.

After successfully negotiating and closing on over 100 bank-negotiated sales in a single year, I found that strong communication, effective timing, and thoroughness were essential.

As Foreclosures Fall, Short Sales Rise

Sarasota, FL – Short sales are currently on the rise while foreclosures fall, according to CNNMoney. During the last quarter of 2011, there were 88,000 short sales (10% of all homes sold). According to Realty Trac, this means short sales have risen 15% compared to a year ago. Foreclosures, on the other hands, have fallen 12% compared to last year (13% of all home sales). At the Troy Funk Team, Sarasota Short Sale Experts, we expect this trend to continue as both homeowners and lenders realize that a short sale is a much better option than legal foreclosure proceedings.

The reasons given for the jump in short sales include:

  1. Both homeowners and lenders better understand the benefits of short sales.
  2. Since both homeowners and lenders agree to the short sale terms, short sales lead to fewer legal issues than foreclosures do.
  3. Short sales take less time to complete than foreclosures do.  Short sales average less than year to complete, whereas foreclosures can take years to finish.
  4. Short sales bring in a better sale price. The average short sale sold for $184,221, while the average foreclosure sold for $149,686, in the last quarter of 2011.
  5. Short sales can come with incentives to homeowners, particularly in Florida and other hard-hit foreclosure states. Incentives include cash rewards to delinquent borrowers.

Foreclosures Fall, Default Notices Rise in Sarasota, Florida, Real Estate Market

Sarasota Foreclosures – February 2012

Sarasota, FL – The Herald Tribune is reporting that foreclosures in Sarasota County, Manatee County, and Charlotte County, Florida have fallen dramatically in February 2012. This news comes as a surprise to many who believed that foreclosures would rise in 2012.

  • Sarasota County filed 394 foreclosures in February, representing a 27% decrease from the previous month and a 9% decrease from the previous year.
  • Manatee County filed 426 foreclosures in February, representing a 35% decrease from the previous month, and a 13% decrease from the previous year.
  • Charlotte County filed 278 foreclosures in February, representing a 33% decrease from the previous month, and only a .4% increase from the previous year.

Some think this decline in foreclosures is simply an aberration, and although it’s doubtful that the foreclosure crisis is behind us, all of us at the Troy Funk Team are pleased by this news. It’s our hope that more homeowners in Southwest Florida are choosing short sales over foreclosures, which is becoming a national trend (recently reported on by CNNMoney) as more understand the benefits of short sales.

Florida Default Notices – February 2012

In contrast, the number of default notices sent to Florida homeowners rose 33% in February (one of the highest increases nationally), according to RealtyTrac.

Short Sale Unilateral Contract

Sarasota, FL – Many homeowners are misled into signing unilateral contracts when they short sale their property. Often this has unfavorable results for the seller when they later discover they have kept their home off the market for a buyer who was never serious about purchasing their property.

So what is a unilateral contract and how can a seller be on guard to avoid such an agreement?

Unilateral contracts are one sided contracts where one party (typically the seller) is bound to the terms of an agreement and the other party (normally the buyer) has the option to terminate an agreement without any obligation. These types of agreements are common for real estate investors who make offers on many short sales but only intend to actually close on the properties they will profit from. In many cases, a real estate investor will try to assign the contract to another buyer prior to closing – for a substantial profit.

However, if the investor is unsuccessful in finding another buyer (for immediate profit), then they will usually terminate the contract under a special clause in said contract. The clause can simply read, “This contract is contingent upon buyer’s approval of a home inspection prior to closing.” In this situation, if the buyer decides not to purchase the property, the buyer can simply state they are not accepting the condition of the property, anytime prior to closing.

In a short sale, if a buyer is not willing to put a deposit in escrow or pay for a home inspection report up front, then beware. A buyer who is not willing to put any money down as a good faith deposit or spend a few hundred dollars to get a home inspection report up front on a short sale purchase has nothing to lose. Whereby a seller facing foreclosure, who takes their home off the market to complete a short sale, for a buyer who does not purchase their property, has lost valuable time.

Should I Pay for Property Insurance on a Short Sale?

Sarasota, FL – Normally when a mortgage is in default, the lender (mortgagee) will continue to pay the property taxes and property insurance through the property owners (mortgagors) established escrow account, which is managed by the mortgagee.

However, what happens if there is not an established escrow account or there are not sufficient funds in the escrow account to cover the property taxes and insurance on a property going in foreclosure in Sarasota or beyond?

This is where the expertise of an experienced Short Sale Agent is important – because not taking this into consideration when trying to complete a short sale can jeopardize a successful short sale transaction.

Let me explain.

Property taxes are normally paid in arrears, which mean they are paid after the tax period for which they are due. As such, property taxes are a somewhat known expense and are addressed in negotiations with lenders in the short sale process. However, property insurance is handled much differently.

Property insurance is paid in advance which can be tricky. In a case where there is a first mortgage that will be satisfied without a short sale and a second mortgage that will be accepting less than what is actually due (by completing a short sale), it is critical to monitor the payoff of the first mortgage throughout the short sale process. A lender’s payment of “Forced Placed Insurance” can drastically change the payoff amount to a first mortgage at the last minute, and can jeopardize a short sale.

When a lender pays the property insurance (forced placed insurance), the insurance premiums could be as much as 4 times what the seller (mortgagor) would pay, had the mortgagor selected their own insurance. This drastic difference can be an unwelcomed surprise based on the timing of a short sale approval and when a lender pays the property insurance. As such, if a seller is able to pay their property insurance in the situation I described, it would be wise for a homeowner to pay their own property insurance and cancel the insurance after the sale of their property closes.

Sarasota Short Sales – Buyers vs. Players

Beware Short Sale “Get Rich” Schemes

In my Sarasota Short Sales Office right in downtown Sarasota, I am constantly bombarded with emails from so-called “short sale experts” who, for a nominal fee, will reveal secrets on how to become wealthy through the buying and selling short sales in Sarasota and beyond. Some even claim that all this short sale buying and selling can be done with no money down and no risk to the buyer.

What happens when a homeowner, facing foreclosure, is approached in this manner?

Homeowners facing foreclosure are usually under great duress, and are seeking a quick and painless solution to their financial troubles. Once their financial situation becomes public record, showing their mortgage in default (with a Lis Pendens being filed against them at the local court house), they will often be approached by many “potential” buyers who want to purchase the property in a short sale.

Be Wary of Potential Short Sale Fraud

Many who claim to be “real buyers” many turn out to be “game players” – real estate investors who intend to resell the property once the short sale is approved, but if these real estate investors are not successful in their “Game” to resell the property for more money prior to closing, then they may leave the seller without a sale. This can be extremely frustrating for a seller who has kept the property off the market an extended period of time, thus preventing “Real Buyers” from purchasing the short sale.

The real estate investors who are engaging in this practice are committing fraud; playing a game against the seller by not being a real short sale buyer.

Find an experienced Sarasota Short Sale Agent –
One who can distinguish a real buyer from a game player

Even when a seller lists their Sarasota short sale property with a real estate agent, they may be susceptible to “Game Players.” If a seller lists their property with an inexperienced Short Sale Agent, they could fall victim to a Short Sale “Game Player.” The Short Sale Real Estate agent representing them must be experienced in protecting the seller, and screening Short Sale “Game Players” from “Real Buyers.”
